GENERAL TERMS AND CONDITIONS OF THE ONLINE SHOP (GTC)

 

General

These General Terms and Conditions (GTC) regulate all legal relationships between MinaDays.com and purchase contracts concluded with its customers, whether via the online shop, email, telephone, or fax. Any provisions of the buyer that contradict these GTC are hereby expressly excluded.

In the event of a contract being concluded, the contract is made with:

The seller can be reached by email info@minadays.com . Orders, inquiries, complaints and other declarations of intent are to be sent to this address.

 

Offer and Delivery

The offer is available on the website MinaDays.com and is non-binding. Product information is primarily for illustration and is non-binding. Price and assortment changes as well as technical changes are reserved. Offers are only valid as long as they are visible on the website and while stocks last.

Orders and deliveries are only possible within Switzerland, Austria and Germany.

In the online shop, the buyer submits a legally binding offer to conclude a contract by sending their order and simultaneously acknowledging these GTC. The contract is concluded when the buyer receives an order confirmation from the seller by email. The delivery method and delivery costs are shown in the online shop.

Information on availability and delivery times is not binding. If an item is not in stock, the buyer will be informed as soon as possible when delivery can be expected. The seller is not liable for delivery delays caused by manufacturers or third parties. All information on delivery times is therefore without guarantee and subject to change at any time. Delivery is at the buyer's risk and expense (no liability for loss, damage, theft, etc.). Shipment tracking, delivery service claims and delivery service complaints are the responsibility of the customer.

 

Prices and Payment

Prices are quoted from Switzerland in Swiss francs (CHF), incl. statutory VAT. For Germany and Austria, prices are quoted in Euros (EUR), incl. statutory VAT. Changes to published prices and conditions are reserved, whereby the date of the order by the buyer applies as the cut-off date.

Payment for ordered goods is made in advance, optionally by credit card, PayPal, Twint, ApplePay, GooglePay, ShopPay. For online payments, the value of the goods is charged on the day the order is received. The seller reserves the right to exclude buyers from individual payment options without stating reasons.

For credit card payments, the contract and data protection provisions of www.mollie.com apply.

For payments with Twint, ApplePay, ShopPay, PayPal, GooglePay, Klarna, etc., the contract and data protection provisions of the respective providers apply.

The delivered goods remain the property of the seller until full payment. The seller is entitled to make a corresponding entry in the register of retention of title. If the buyer defaults on payment of the purchase price, the seller is entitled, among other things, to withdraw from the contract and to take back the goods.

 

Order process

The order is placed in the following steps:

  1. Selection of desired goods
  2. Confirmation by clicking the "Add to cart" button
  3. Check the details in the shopping cart
  4. Confirmation by clicking the "Checkout" button
  5. Selection of payment method and entry of buyer's data
  6. Re-checking or correcting the respective entered data
  • By clicking the "Buy Now" button, you are submitting a binding order, making payment, and simultaneously accepting the General Terms and Conditions.
  • Confirmed orders can no longer be cancelled or changed by the buyer.

     

    Warranty and Liability

    Complaints due to defects or incomplete or incorrect delivery must be reported to the seller immediately, but no later than 3 days from the delivery date, in writing. Hidden defects must be reported to the seller immediately, but no later than 3 days after discovery, in writing. If the buyer fails to report the defect in time, their claims will lapse. After the return of the complained goods, the buyer will receive a replacement delivery if a defect exists. If a replacement delivery is not possible, the seller will refund the payment made. Furthermore, any claim for reduction, rescission, or compensation for consequential damages, to the extent permitted by law, is excluded. No liability is assumed for transport damage or loss of shipment, and these must be reported directly to the shipping service provider.

    The buyer forfeits any defect rights in case of improper use of the goods. Defects resulting from normal wear and tear, as well as those due to improper handling or damage by the buyer or third parties, and defects caused by external circumstances (improper storage, frost, heat, moisture, incorrect storage, etc.), do not entitle the buyer to withdraw from the contract or to replace the goods. The seller assumes no liability for this. Returns of goods are at the buyer's expense and risk. Products must be professionally packaged in their original packaging and sent by registered mail. If the seller cannot identify any defects covered by the warranty or manufacturer's guarantee, the seller may charge the buyer for the costs of inspection and shipping of the goods.

    Other claims of the buyer – regardless of the legal basis – are excluded to the extent permitted by law. The seller, its assistants, and any vicarious agents are not liable for damages that did not occur to the goods themselves, in particular not for consequential damages, loss of profit, or other financial losses of the buyer. Any liability of the seller in connection with the offer (especially incorrect images, texts, and prices) and delivery is excluded to the extent permitted by law.

    Products that the buyer ordered by mistake will neither be taken back nor refunded.

    Disclaimer

    Exclusion of all liability regarding products, effects, incompatibilities, undesirable side effects, damage, and consequential damage. Patch tests in an inconspicuous area are recommended first to check for compatibility. In case of known incompatibilities or allergies, avoid corresponding ingredients or consult a doctor beforehand.

    All contracts concluded with the seller are subject to Swiss law, excluding the substantive norms of conflict of laws and the United Nations Convention on Contracts for the International Sale of Goods (CISG).
